10765.0 1 CITY OF SANTA FE, NEW MEXICO1 BILL NO. 2026-142 INTRODUCED BY:3 4 Councilor Jamie Cassutt5 Councilor Patricia Feghali6 7 8 9 A BILL10 AMENDING SECTION 14-7.9, SFCC 1987, TO CLARIFY A PARK IMPACT FEE11 EXEMPTION AS IT RELATES TO CERTAIN CONSTRUCTION PERMITS.12 BE IT ORDAINED BY THE GOVERNING BODY OF THE CITY OF SANTA FE:13 Section 1. Section 14-7.9 of SFCC 1987, Subsections A-D and F-L (being Ord.14 No. 2025-25, as amended) are omitted for readability. Section 14-7.9(E) of SFCC 1987 is15 amended to read:16 14-7.9 – Impact Fees.17 E. Exemptions, Waivers, and Reimbursements18 I. The following are exempt from the provisions of this section:19 a. Alterations of, or additions to, existing residential uses where no additional20 dwelling units are created;21 b. Replacement of a destroyed, partially destroyed, or moved residential22 building or structure with a new building or structure of the same use and23 the same size and the same number of dwelling units;24 c. Replacement of destroyed, partially destroyed or moved nonresidential25 underscored material = new [bracketed material] = delete 10765.0 2 building or structure with a new building or structure of the same gross1 floor area and use;2 d. [Construction permits for new residential units that are part of a master3 plan, development plan or subdivision plat where land is dedicated to the4 City to provide park land, as provided in Section 14-6.3, Dedication and5 Development of Park Land, Open Space, Trails, and Recreation6 Facilities;]7 [e] Parking garages, parking canopies, or parking lots;8 [f]e. Construction permits for uses specified in Section 14-4.5(A)(11)9 located within the Airport Road Overlay District;10 [g]f. Construction permits for qualifying projects within the Midtown11 LINC overlay district as defined in Section 14-4.5(C)(4); and12 [h]g. Santa Fe Homes Program projects receiving enhanced affordability13 incentives as described in Section 14-7.2(F).14 II. Park impact fee exemption. Construction permits for new residential units that are part15 of a master plan, development plan or subdivision plat where land is dedicated to the16 City to provide park land may be exempt from park impact fees, as provided in Section17 14-6.3, Dedication and Development of Park Land, Open Space, Trails, and Recreation18 Facilities.19 III.
