Summary:
The proposed bill prohibits and regulates the use of City of Santa Fe (“City”) property for immigration
enforcement purposes and requires employers to notify employees of immigration enforcement and I-9
audits.
Specific to the prohibition against the use of City property for immigration enforcement purposes, the
proposed bill prohibits immigration enforcement agents from entering City-owned spaces which have been
designated “Community Refuges”. Additionally, this bill prohibits immigration enforcement agents from
using any City-owned or operated structure or venue for immigration enforcement purposes, including as
a staging area, processing location, or operations base.
Specific to immigration enforcement, this bill establishes the following requirements:
1) that employers in Santa Fe provide written notice to employees no later than twenty-four (24) hours
after receiving notice by an immigration agency of an I-9 audit;
2) that employers provide written notice no later than twenty-four (24) hours after a federal
government agency determines that an employee’s work authorization documents do not establish
that the employee is authorized to work in the United States; and
3) that employers provide written notice no later than twenty-four (24) hours after a law enforcement
agency engaging in or supporting immigration enforcement is present at a place of work.
Further, if an employer fails to provide notice to an employee in the circumstances listed above, the
employee’s family member or domestic partner may submit a written complaint to the city manager and
the city manager may recommend that the employer’s business license be suspended.

Consequences of Not Enacting Legislation:
If this legislation is not adopted, status quo in the City’s approach to immigration enforcement will continue.
Conflict, Duplication, Companionship, or Relationship to Other Legislation:
There are multiple past-adopted resolutions germane to the topic of welcoming and supporting immigrant
communities in Santa Fe: Resolution Nos. 1985-129, 1999-06, 2002-3, 2014-82, 2017-19, and 2025-31.
Performance and Administrative Implications:
Should this bill be adopted, the City will be responsible for developing policies and procedures necessary
to implement this bill, including policies for staff training and procedures for ensuring appropriate signage.
Additionally, the City will make a template available for Santa Fe businesses to use when notifying
employees of immigration enforcement activity.
Fiscal Implications:
***If adopted, there will be an associated cost of approximately $20,000 per year, for the creation of signage
to identify city-owned and controlled structures or venues, including but not limited to parking lots, vacant
lots, garages, parks, and similar structures or venues that could be used as a staging area, processing
location, or operations base for the purposes of immigration enforcement.
