10777.1 1 CITY OF SANTA FE, NEW MEXICO1 RESOLUTION NO. 2026-__2 INTRODUCED BY:3 4 Councilor Pilar Faulkner5 Councilor Lee Garcia6 Councilor Amanda Chavez7 Mayor Michael Garcia8 9 10 A RESOLUTION11 AFFIRMING THE CITY OF SANTA FE’S COMMITMENT TO PAST RESOLUTIONS12 SUPPORTING IMMIGRANT COMMUNITIES IN SANTA FE AND RECOGNIZING THE13 CITY’S POLICE AND FIRE DEPARTMENT’S ROLES; ENCOURAGING ALL14 RESIDENTS, REGARDLESS OF IMMIGRATION STATUS, TO RELY ON LAW15 ENFORCEMENT AND EMERGENCY SERVICES; ENCOURAGING ALL16 COMMUNITY MEMBERS AND COMMUNITY LEADERS TO FACT-CHECK PUBLIC17 SAFETY INFORMATION.18 19 WHEREAS, the City of Santa Fe (“City”) Charter, Article II, Section 2.02, “Human and20 Civil Rights”, states that the City holds human and civil rights as inviolate and states that these21 rights “shall not be diminished or otherwise infringed” regardless of “ethnicity, race, age, religion,22 creed, color, national origin, ancestry, sex, gender, sexual orientation, physical or mental disability,23 medical condition or citizenship status”; and24 WHEREAS, the City has a long history of upholding the broad policy position of25 10777.1 2 welcoming and supporting immigrant communities as demonstrated in the adoption of the1 following resolutions:2 • Resolution No. 1985-129, declaring Santa Fe a city of refuge for Salvadorans and3 Guatemalans; and4 • Resolution No. 1999-06, declaring a policy of non-discrimination on the basis of5 a person’s national origin and appointing an immigration taskforce, and resolving6 that “all persons will be treated equally, with respect and dignity, regardless of7 immigration status”; and8 • Resolution No. 2014-82 declaring Santa Fe’s continuous support for immigrant9 issues in Santa Fe, in the State of New Mexico, and throughout the United States,10 and calling on the federal government to immediately stop the expansion of family11 detention centers and the prolonged detention and expedited deportation of12 refugees and immigrants ; and13 • Resolution No. 2017-19 to safeguard residents’ sensitive personal information,14 reaffirming the City’s commitment to human and civil rights, to the established15 rule of law, and its status as a welcoming community for immigrants and refugees;16 and17 WHEREAS, the City’s government has a record of implementing non-discrimination and18 inclusive policies toward Santa Fe residents in order to establish itself as a welcoming community,19 regardless of immigration and citizenship status:20 • Resolution No. 1985-129, Section 2, states that “the City of Santa Fe, its agents,21 agencies, officers, and employees, in performance of official duties, shall not, to22 the extent legally possible, assist or voluntarily cooperate with Immigration and23 Naturalization Service investigations or arrest procedures relating to alleged24 violations of immigration law”; and25 10777.1 3 • Resolution No. 1999-06 declared that “no municipal resources will be used to1 identify or apprehend any non-citizen resident on the sole basis of immigration2 status, unless otherwise lawfully required to do so,” and Santa Fe Police3 Department (SFPD) Rule No. 76.1.02(G)(2) on “Foreign diplomats/Consular4 Officials: Foreign Nationals and Immigration Laws” cites to the same;5 • Resolution No. 2017-19 established multiple City practices that established “its6 status as a welcoming community” including the following prohibitions:7 1. No City employee may make “inquiry regarding immigration status of any8 person, except as required by law, to determine eligibility for city9 employment;10 2. No City employee may disclose to any person or agency outside City11 government “any sensitive information about any person that comes into12 the employee’s possession during the course and scope off that employee’s13 work for the City of Santa Fe, except as required by law, in order to14 provide a City service or carry out a function of City government or upon15 receipt of a valid court order”; and16 3. City elected and appointed officials and employees “shall refuse access to17 all non-public areas of City property by federal immigration agents for the18 purposes of enforcing federal immigration laws who do not present a19 warrant issued by a federal court specifically requiring such access”; and20 WHEREAS, it is essential that all members of the community hold trust with and for the21 City’s institutions, including its public safety agencies, especially during times of uncertainty; and22 WHEREAS, the Governing Body believes accurate information is essential for the23 wellbeing and health of the Santa Fe community; and24 WHEREAS, the Governing Body encourages all community leaders and all residents to25 10777.1 4 verify the accuracy of information with respect to the operations of federal immigration agents in1 Santa Fe to avoid spreading rumor and misinformation; and2 WHEREAS, the Governing Body has trust and confidence in all public safety employees3 to uphold the City’s status as a welcoming community for immigrants and, as established by prior4 resolutions and by agency policies, as they relate to immigration status.5 NOW, THEREFORE, BE IT RESOLVED BY THE GOVERNING BODY OF THE6 CITY OF SANTA FE that the City affirms its commitment to, and will continue to uphold, all7 requirements of Resolution Nos. 1985-129, 1999-06, 2014-82, and 2017-19.8 BE IT FURTHER RESOLVED that the Governing Body supports and has confidence in9 the Santa Fe Police Department and Santa Fe Fire Department to discharge all duties in such a10 manner that reflects the policies established by all prior-adopted resolutions and agency policies,11 and it encourages all residents, regardless of immigration status, to rely on law enforcement and12 emergency services; and13 BE IT FURTHER RESOLVED that the Governing Body encourages all community14 members and community leaders to fact-check information with respect to the operations of federal15 immigration agents in Santa Fe before sharing broadly in order to prevent the spread of16 misinformation and to support trust and confidence in our local community.17 PASSED, APPROVED, and ADOPTED this ______day of ___________, 2026.18 19 20 ____________________________21 MICHAEL J.
