Summary:
The proposed resolution would approve the Santa Fe Trails Fiscal Year 2026 Public Transportation Agency
Safety Plan (“PTASP”). The Santa Fe Trails PTASP is a requirement of the United States Department of
Transportation, Federal Transit Administration (“FTA”) for public transportation systems that receive
federal funding under the FTA’s Urbanized Area Formula Grant.

Consequences of Not Enacting Legislation:
If this legislation is not adopted, the City of Santa Fe, Santa Fe Trails, will violate the requirements
adopted in 49 U.S.C. § 5329(d), the “Bipartisan Infrastructure Law”. Under 49 U.S.C. § 5329(g), the
Secretary of Transportation is authorized to take a range of enforcement actions against any recipient that
does not comply with federal law with respect to the safety of its public transportation system 49
U.S.C.A. § 5329. These enforcement actions include: (1) issuing directives; (2) requiring more frequent
oversight of the recipient by a State safety oversight agency or the Secretary; (3) imposing more frequent
reporting requirements; (4) requiring that any federal financial assistance provided under Chapter 53 be
spent on correcting safety deficiencies identified by the Secretary or the State safety oversight agency
before such funds are spent on other projects; and (5) withholding not more than 25% of financial
assistance under § 5307.
Conflict, Duplication, Companionship, or Relationship to Other Legislation:
Resolution No. 2025-47 approved and updated the last version of the most recent version of the Santa Fe
Trails Agency Safety Plan.
Performance and Administrative Implications:
Once approved by the Governing Body, staff will submit the PTASP to the FTA and the New Mexico
Department of Transportation for approval.
