Nguyen, nanguyen@santafenm.gov, (505) 819-1870) BACKGROUND AND SUMMARY: City may donate any City-owned real estate to the State without violating the Anti-Donation Clause of the New Mexico Constitution. Commission has requested that City donate the public alley (the Alley ) located on the north side of East De Vargas Street, adjacent to and east of the Supreme Court building to the Commission for the purpose of enhancing security of the Supreme Court building, its judges, staff, and invitees. City Staff has assessed the Commission s request and the Alley and has determined that the City has no plans for the Alley and the conveyance of the Alley to the Commission would not affect the community adversely, so long as an easement is granted to the two properties on the east side of the Alley (127 and 129 E. De Vargas) for access and underground utilities and provided a utility easement is reserved by City. A City-approved appraiser, American Property Consultants and Appraisers, Inc. performed an appraisal of the Alley, and determined that the fair market value of the Alley is $69,000.00. Upon approval of this Agreement by the Governing Body, the City is prepared to execute the Quitclaim deed, conveying the Alley to Commission as a donation.
