PETITION FOR APPEAL AND REQUEST TO MODIFY CEASE AND
DESIST ORDER
INTRODUCTION
Appellant Francisco Romero, individually and on behalf of Green Light Multifactor, LLC ("Green Light"),
respectfully petitions the City of Santa Fe Governing Body for review of the Cease and Desist Order issued
following the Finance Committee hearing of August 24, 2026, pursuant to SFCC § 18-1.8(D).
This appeal is intentionally narrow. Appellant is not requesting authorization to continue cannabis retail sales
at 1228 Parkway Drive, Suite D. Green Light has changed its business plan: the retail brand has been sold to
an investor, Appellant does not intend to renew the state authorization necessary to continue retail operations,
and Appellant no longer seeks to conduct cannabis retail sales at this property.
Appellant instead requests that the August 24 Order be modified so that it does not operate as a blanket
prohibition on every lawful business use of the premises. Green Light seeks the ability to pursue lawful light
manufacturing and other non-retail activity, but only to the extent such activity is permitted by the
property's zoning and only after obtaining every City and State license, permit, zoning approval, or other
authorization that may be required.
GROUNDS FOR APPEAL
The July 15, 2026 Notice of Violation identifies the disputed use as a "Retail Cannabis business" and states
that retail cannabis was not allowed at the Parkway location. The subsequent August 24, 2026 Cease and
Desist Order, however, directs Appellant to cease conducting "any business" at the property until compliance
with the cited provisions.
Because Appellant no longer seeks to conduct the disputed retail use, Appellant respectfully asks the
Governing Body to tailor the remedy to the conduct that gave rise to the enforcement proceeding. A
continuing prohibition against all business activity would prevent Green Light from even pursuing a different,
otherwise lawful use through the City's normal zoning and licensing processes.
Appellant is not asking the Governing Body in this appeal to make a final determination that light
manufacturing is presently authorized at 1228 Parkway Drive. Rather, Appellant requests the opportunity to
submit that proposed use for ordinary review by the appropriate City departments and to operate only after all
required approvals are obtained.
MATERIAL CHANGE IN BUSINESS OPERATIONS

Since the events underlying the Notice of Violation, Green Light's intended operations have materially
changed. Appellant has sold the retail brand to an investor; does not seek to continue cannabis retail at 1228
Parkway Drive; does not intend to renew the state retail authorization for Green Light; and seeks to transition
the premises, if legally permissible, to light manufacturing and other non-retail operations.
The New Mexico Cannabis Control Division stated in a July 24, 2026 letter that Green Light Multifactor LLC
currently has a valid Integrated Cannabis Microbusiness license. Appellant submits that letter as Exhibit C for
the limited purpose of documenting the license status stated by CCD on that date. Appellant does not
represent that the letter adjudicates any separate investigation or authorizes a particular use at the Parkway
property.
REQUESTED RELIEF
Appellant respectfully requests that the Governing Body:
1. MODIFY the August 24, 2026 Cease and Desist Order to make clear that Green Light shall not conduct
cannabis retail sales at 1228 Parkway Drive, Suite D, unless separately authorized in the future by all
applicable authorities;
2. REMOVE OR NARROW the blanket prohibition against conducting "any business" at the premises so
that it does not bar lawful non-retail activity that is independently permitted and properly licensed;
3. ALLOW Green Light to apply for zoning verification, business registration, permits, licenses, certificates,
and other approvals necessary for proposed light manufacturing or other non-retail activity at the property;
4. DIRECT the appropriate City departments to evaluate any proposed light-manufacturing/non-retail use
under the zoning and land-use requirements applicable to 1228 Parkway Drive, without treating the former
retail use as an automatic prohibition on a different lawful use;
5. CLARIFY that the Finance Committee Order does not, by itself, prevent Francisco Romero or Green Light
from applying for zoning verification, business licensing, or other City approvals for lawful operations at
other properties; and
6. GRANT such other relief as the Governing Body deems appropriate to resolve this matter while ensuring
compliance with the Santa Fe City Code.
GOOD-FAITH COMPLIANCE
This appeal seeks a practical resolution. Appellant accepts that cannabis retail activity at 1228 Parkway Drive
will cease and is not asking the Governing Body to preserve that retail use. Appellant asks only that the
enforcement remedy be narrowed so that Green Light may pursue a different lawful use through the City's
normal review process.
Appellant is prepared to work cooperatively with Land Use, Business Licensing, Code Enforcement, and
other appropriate agencies and will not commence any proposed light-manufacturing or other regulated
activity unless and until all approvals required for that activity and location have been obtained.
